0. Purpose

These General Terms and Conditions regulate the purchase of products, the booking of visits, tastings, wine tourism experiences, gift vouchers and any other services offered through the website www.masoller.cat, owned by JARO S.L., under the commercial brand Mas Oller.

The purchase of any product or the booking of any service implies full and unconditional acceptance of these General Terms and Conditions, without prejudice to any specific conditions that may apply to certain products, promotions, experiences or gift vouchers.

JARO S.L. reserves the right to modify these General Terms and Conditions at any time. The applicable conditions shall be those in force at the time the purchase or booking is made.

3. Products, visits and services offered

The products, visits, tastings, experiences and other services offered on www.masoller.cat are described on the website, together with their main features, price, duration, availability and, where applicable, specific conditions.

Mas Oller reserves the right to modify, add, withdraw or discontinue, at any time and without prior notice, any products, services, visits or experiences available on the website.

The images, descriptions and content published are for information purposes only. Mas Oller will endeavour to ensure that the information is accurate and up to date, although variations may occur due to availability, vintage, weather conditions, internal organisation or circumstances beyond the winery’s control.

4. Availability and substitutions

Mas Oller will endeavour to guarantee the availability of the products and services published on www.masoller.cat. However, if a requested product is not available or is out of stock, the customer will be informed as soon as possible.

In the event of product unavailability, Mas Oller may offer the customer a product with similar characteristics and an equivalent or higher price at no additional cost. The customer may accept or reject such substitution, in which case the amount paid will be refunded using the same payment method used for the purchase.

In the case of visits, tastings or experiences, availability will be subject to the calendar, timetables, capacity, language, internal organisation and specific conditions of each activity.

5. Purchase and/or booking process

To make a purchase or booking on www.masoller.cat, the user must be of legal age and provide truthful, accurate and complete information.

The usual purchase or booking process shall be as follows:

1. Select the desired product, visit, tasting, experience or gift voucher.

2. Review the features, price, availability and specific conditions.

3. Add the product or service to the basket or complete the corresponding booking form.

4. Enter the information requested to manage the purchase or booking.

5. Accept these General Terms and Conditions and the Privacy Policy.

6. Make the payment using the available payment methods.

7. Receive confirmation of the purchase or booking at the email address provided.

The customer is responsible for checking that the information provided is correct, especially email address, telephone number, date, time, number of people and delivery address, where applicable.

Mas Oller shall not be responsible for errors in the management of orders or bookings resulting from incorrect or incomplete information provided by the customer.

6. Invoicing

The customer will receive the corresponding invoice or proof of purchase where applicable.

Unless expressly indicated otherwise, the customer agrees that the invoice may be issued and sent electronically to the email address used during the purchase or booking process.

The customer may request a paper invoice or a copy of the electronic invoice by contacting Mas Oller through the channels indicated in these General Terms and Conditions.

7. Delivery of products

Physical products purchased through www.masoller.cat will be delivered to the address indicated by the customer during the purchase process.

The delivery area may include Spain, Europe or other destinations available at any given time, according to the options indicated on the website or during the purchase process.

Delivery times are approximate and will depend on the destination, product availability, transport agency and logistical circumstances. Mas Oller will endeavour to deliver orders as quickly as possible.

The customer must check the condition of the package upon delivery. If visible damage, breakage or signs of tampering are observed, this must be reported to the carrier and communicated to Mas Oller as soon as possible.

8. Prices, costs and taxes

Prices published on www.masoller.cat are expressed in euros and include the corresponding VAT, unless expressly stated otherwise.

The final price of each product, visit, tasting, experience or service will be displayed before completing the purchase or booking process.

Shipping costs, where applicable, will be indicated during the purchase process and may vary depending on the destination, weight, volume or conditions of the order.

Mas Oller reserves the right to modify prices at any time. However, the applicable price shall be the one in force at the time the purchase or booking is made, except in the case of a manifest error.

9. Payment methods

Mas Oller makes available to the customer the payment methods indicated during the purchase or booking process.

Payment may usually be made by credit or debit card through a secure payment gateway.

In the event of a return, cancellation or refund, the amount will be reimbursed, whenever possible, using the same payment method used by the customer for the initial purchase or booking.

Mas Oller does not store complete bank card details, as payments are managed through external secure payment platforms.

10. Booking of visits, tastings and experiences

The visits, tastings and wine tourism experiences offered by Mas Oller have a specific date, time, duration, language, capacity and conditions.

The booking will be confirmed once the corresponding process has been completed and payment has been received, unless another confirmation method is expressly indicated.

The customer must arrive punctually at the indicated location. In the event of delay, Mas Oller cannot guarantee that the customer will be able to join the activity, especially if this affects the proper development of the visit or the other participants.

Mas Oller may group visitors for reasons of language, capacity, availability or internal logistics.

Activities may be modified due to weather, organisational, technical, safety or force majeure reasons. In such cases, Mas Oller will endeavour to offer the customer a reasonable alternative.

11. Cancellation and modification policy for visits, tastings and experiences

Bookings for visits, tastings and wine tourism experiences may be modified or cancelled free of charge up to 48 hours before the scheduled date and time of the activity.

Modifications will always be subject to availability.

Cancellations made less than 48 hours in advance will not entitle the customer to a refund of the amount paid.

In the event of no-show on the day of the activity, or arrival with a delay that prevents the proper completion of the visit, tasting or experience, the booking will be considered used and will not be refundable.

If Mas Oller is forced to cancel or modify an activity due to weather, organisational, technical, safety or force majeure reasons, the customer will be offered the possibility of changing the date of the activity or receiving a refund of the amount paid.

To request changes or cancellations, the customer must contact Mas Oller by email at info@masoller.cat or by calling the telephone number indicated on the website.

For private groups, special events or experiences with specific gastronomic services, Mas Oller may apply particular cancellation conditions, which will be communicated to the customer before confirming the booking.

12. Gift vouchers

Gift vouchers purchased through www.masoller.cat shall be valid for 12 months from the date of purchase, unless another period is expressly indicated on the voucher itself or on the purchase page.

Gift vouchers are non-refundable once issued. However, during their validity period, the beneficiary may modify the date of the experience, subject to availability and in accordance with the booking conditions established by Mas Oller.

Once the voucher has expired, it cannot be redeemed and will not entitle the holder to a refund of the amount paid, unless expressly agreed by Mas Oller.

The gift voucher must be presented on the day of the activity or provided to Mas Oller in advance for proper validation.

13. Right of withdrawal and returns

In the case of the purchase of physical products through the online store, the consumer may exercise the right of withdrawal within 14 calendar days from receipt of the order, without needing to provide any reason.

To exercise the right of withdrawal, the customer must notify Mas Oller within the indicated period by email at info@masoller.cat.

The product must be returned in perfect condition, unused, in its original packaging and with all accessories, labels and documentation, where applicable.

Once the product has been received and its condition checked, Mas Oller will refund the amount paid within a maximum period of 14 calendar days, using the same payment method used by the customer, unless expressly agreed otherwise.

Return costs shall be borne by the customer, except in cases of defective product, shipping error or cause attributable to Mas Oller.

The right of withdrawal shall not apply, among others, to:

• Products customised or made according to the customer’s specifications.

• Products that may deteriorate or expire quickly.

• Unsealed products that cannot be returned for hygiene or health protection reasons.

• Alcoholic beverages whose actual value may depend on market fluctuations beyond Mas Oller’s control.

• Bookings for visits, tastings, wine tourism experiences or other leisure services linked to a specific date or period of performance, without prejudice to the cancellation and modification policy set out in these General Terms and Conditions.

14. Legal guarantee

Products purchased through www.masoller.cat are covered by the legal guarantee applicable at any given time under current legislation.

Mas Oller shall be liable to the consumer for any lack of conformity existing at the time of delivery of the product, under the terms established by applicable law.

In the event of a defective, damaged or non-conforming product, the customer must contact Mas Oller as soon as possible through the channels indicated in these General Terms and Conditions, providing a description of the incident and, where possible, photographs of the product and packaging.

Damage caused by improper use, storage or handling of the product, as well as damage resulting from external causes not attributable to Mas Oller, is excluded from the guarantee.

15. Sale of alcoholic beverages

The sale of alcoholic beverages to persons under 18 years of age is prohibited.

By purchasing wine or other alcoholic products on www.masoller.cat, the customer declares that they are of legal age and have sufficient legal capacity to enter into a contract.

Mas Oller reserves the right to cancel any order if there are indications that the purchase has been made by a minor or in breach of applicable regulations.

16. Liability

Mas Oller undertakes to provide its services with the utmost diligence and professionalism.

However, Mas Oller shall not be liable for breaches, delays or incidents resulting from force majeure, external technical problems, service interruptions, third-party errors, transport incidents, weather conditions, administrative restrictions or any other circumstance beyond its reasonable control.

The user undertakes to make appropriate use of the website, the contracted services and the information provided, refraining from carrying out any unlawful, fraudulent or bad-faith activity.

The personal data provided by the user will be processed in accordance with the Privacy Policy of www.masoller.cat.

The user may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability by contacting Mas Oller at info@masoller.cat.

19. Applicable law

These General Terms and Conditions shall be governed by current Spanish law.

In the event of any dispute, the parties shall submit to the courts and tribunals that are competent in accordance with the applicable consumer and user regulations.
