0. OBJECT

These General Conditions regulate the acquisition of the products offered on the website www.masoller.es, owned by JARO SL (hereinafter, Can Rafols). The acquisition of any of the products implies full and unconditional acceptance of each and every one of the General Conditions indicated, without prejudice to the acceptance of the Specific Conditions that may apply when acquiring certain products. These General Conditions may be modified without prior notice; therefore, it is advisable to carefully read their content before proceeding with the acquisition of any of the offered products.

3.PRODUCTS

The offered products, along with their main characteristics and price, are displayed on the screen. Can Rafols reserves the right to decide, at any time, the products and/or services offered to Customers. Thus, Can Rafols may, at any time, add new products and/or services to those currently offered. Likewise, Can Rafols reserves the right to withdraw or stop offering, at any time, and without prior notice, any of the offered products. Once inside www.masoller.es, and to access the contracting of the different products, the User must follow all the instructions indicated in the purchase process, which will imply the reading and acceptance of all the general and specific conditions set forth on www.masoller.es.

 

4.​AVAILABILITY AND SUBSTITUTIONS PRODUCTS

Can Rafols aims to guarantee the availability of all products advertised through www.masoller.es. However, in the event that any requested product is not available or if it is sold out, the customer will be informed via email as soon as possible. If the product is not available, and having informed the consumer of this, Can Rafols may supply a product with similar characteristics at no additional cost, in which case, the consumer may accept it or reject it by exercising their right of withdrawal and contract resolution. In the event of unavailability of all or part of the order, and the rejection of the substitution products by the customer, the previously paid refund will be made by the same payment method that the customer used in their purchase. If Can Rafols delays unjustifiably in the refund of the amounts paid, the consumer may claim double the amount owed.

 

​5.PURCHASE AND/OR CONTRACTING PROCESS

To make any purchase on www.masoller.es, it is necessary for the customer to be of legal age. Additionally, it will be necessary for the customer to register on www.masoller.es through a data collection form in which the necessary information for contracting is provided to Can Rafols; information that will in any case be truthful, accurate, and complete regarding their identity, and which the customer must expressly consent to by accepting Can Rafols' privacy policy. The steps to follow to make the purchase are: Select the products you wish to purchase. When finished, access the shopping cart to check your purchase. Add or remove products from your cart. Proceed to the payment and shipping process. The customer can check their previous purchases in their user account, or by requesting a copy in the customer service email. It is also advisable for the customer to print and/or save a copy of the sales conditions when placing their order, as well as the receipt sent by Can Rafols via email. BILLING With your order, you will receive the corresponding invoice. To this end, the customer consents to receive this invoice electronically. The customer will receive it at the email address they used in their purchase. They may, at any time, revoke this consent by requesting it through customer service to receive the invoice on paper.

 

​6.DELIVERY PRODUCTS

7.PRICES, EXPENSES, AND TAXES

The prices of the products listed on www.masoller.es will be expressed in Euros unless otherwise stated, and will be guaranteed during their validity period, except for printing errors and regardless of the destination of the order. PRODUCTS The final prices of all products (and, where applicable, the final prices per unit of measure, when mandatory), along with their characteristics, offers, discounts, etc., are reflected for each of the items listed in the www.masoller.es catalog. The products include VAT. The VAT rate is 21%. Shipping costs: Shipping costs will be indicated at the time of purchase, depending on the quantity and destination. The prices of the products may vary at any time. In this case, the price to be applied will be the one valid on the date of the order. In any case, the final cost will be communicated to the customer in the electronic purchasing process before they formalize their acceptance.

 
8.PAYMENT METHODS

We offer you these payment methods: a. By credit or debit card You can make immediate payment through our Bank's SSL secure payment gateway. If it is necessary to make any refund or cancellation of the order, the amount will be refunded through the same payment card.

 

9.RETURNS AND WITHDRAWAL POLICY

As established by regulations, the consumer and user will have the right to WITHDRAW from the contract for a maximum period of 14 natural days without the need to indicate the reason and without incurring any cost, except those provided for in art. 107.2 and 108 of RD1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users. This right of withdrawal does not apply, among others, to: Contracts for the supply of products made according to the consumer and user's specifications or clearly personalized, or which, by their nature, cannot be returned or may deteriorate or expire rapidly. Supply of alcoholic beverages whose real value depends on market fluctuations. PRODUCTS The customer will have a maximum period of 14 natural days from the day of receipt of the requested good or product to inform Can Rafols of their desire to withdraw from the contract. Withdrawal implies that Can Rafols will proceed to refund the amount already paid by the customer within a maximum period of 14 natural days, following the same procedure chosen by the customer for their payment (provided that the purchased product is not within the exceptions indicated above). During this period, the consumer will inform the entrepreneur of their decision to withdraw from the contract by filling out the form found at the end of this document and sending it to Can Rafols' email address. Can Rafols will communicate to the consumer a receipt of said withdrawal in a durable medium. To proceed with the return of a product, it is essential that it be in perfect condition and with its corresponding original packaging, with all its accessories and without having been used. Once we receive your request, we will contact the customer to indicate the details of the return. The customer will bear the return costs of the goods.

 

​10.LEGAL WARRANTY

The products purchased through www.masoller.es have a warranty period of 3 years from the moment of their acquisition, covering any possible manufacturing defects in the product. The customer must contact Can Rafols through the customer service channels as soon as they detect any defect in the purchased products. Deficiencies caused by improper use or handling, or defects derived from any external cause, are excluded from the warranties. Can Rafols will respond to the consumer or user for any lack of conformity existing at the time of delivery of the goods. To bring it into conformity, the consumer or user will have the right to the replacement of the purchased goods subject to a claim.

 

​11.LIABILITY AND EXEMPTION FROM LIABILITY

Can Rafols undertakes not to allow any transaction that is illegal or is considered by credit card brands or the acquiring bank that may or has the potential to harm their goodwill or have a negative influence on them. The following activities are prohibited under the card brand programs: the sale or offer of a product or service that is not in full compliance with all applicable laws to the Buyer, Issuing Bank, Merchant, Cardholder, or cards. Also, the following activities are explicitly prohibited: Sale of alcoholic beverages to minors under 18 years of age. The consumer and user have the right to repair the product, its replacement, a price reduction, or contract resolution, as established in Chapter II Tit. IV Book II of the General Law for the Defense of Consumers and Users. If the product is not in accordance with the contract, the consumer may choose between repairing or replacing the product, both of which will be free for the consumer, and will be carried out within a reasonable time depending on the nature of the products and the purpose for which they were intended. If after repair and delivery of the product, it remains non-compliant with the contract, the consumer may demand its replacement, a price reduction, or contract resolution.

 

12.CUSTOMER SERVICE AND COMPLAINTS

To file any complaint or claim with Can Rafols, the customer must contact the customer service department. According to the EU Online Dispute Resolution for Consumer Affairs and in accordance with Art. 14.1 of Regulation (EU) 524/2013, we inform you that the European Commission provides all consumers with an online dispute resolution platform available at the following link: http://ec.europa.eu/consumers/odr/.

 

13.APPLICABLE LEGISLATION

These conditions will be governed by current Spanish legislation.
